1. Introduction

Welcome to Questiro (“Questiro,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Questiro’s software, services, websites, and applications (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

2. Key Definitions

• Account Owner (sometimes referred to as “Customer,” “Subscriber,” or “Paying Customer”): The individual or entity who creates a paid subscription account with Questiro, is responsible for billing and payment obligations, and typically controls the organization’s Workspace within Questiro.
• Team Members (or “End Users,” “Authorized Users”): Individuals invited by the Account Owner to collaborate within Questiro. They may have varying levels of access and permissions, but are not generally responsible for billing.
• Workspace: The digital environment under the Account Owner’s control, in which Team Members and other collaborators may share data, tasks, projects, and communications.
• User: Refers collectively to Account Owners and Team Members (and any other individual accessing the Services).

3. Eligibility

• Minimum Age: You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Services.
• Authority: If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Accepting These Terms

• Acceptance by Account Owner: By creating a paid subscription, the Account Owner agrees to these Terms on behalf of themselves and all Team Members within the Workspace.
• Acceptance by Team Members: If you are invited to join a Workspace, you are bound by these Terms when you first access or use the Services.

5. Account Registration & Responsibilities

5.1 For Account Owners (Paying Customers)

• Account Setup: You will create a Questiro account and provide accurate billing information. You agree to keep this information up to date.
• Billing & Payments:
  • You are responsible for all fees associated with your chosen subscription plan, as indicated at the time of purchase.
  • Subscription fees may be charged in advance on a recurring basis (e.g., monthly or annually).
  • You authorize Questiro (or our third-party payment processor) to charge your credit card or other payment method.
• Team Management:
  • You can invite and remove Team Members from your Workspace.
  • You control the roles and permissions assigned to each Team Member.
• Compliance:
  • You ensure that all Team Members comply with these Terms.
  • You are responsible for the conduct of Team Members in your Workspace (e.g., compliance with Acceptable Use, data shared, etc.).

5.2 For Team Members (End Users)

• Account Information: If you are invited to join a Workspace, you must provide accurate information when creating your user profile (e.g., your name and email address).
• Permissions: Your access level and permissions are determined by the Account Owner or administrators designated by the Account Owner.
• Compliance: You agree to use the Services in accordance with these Terms, any additional policies referenced (like our Acceptable Use Policy), and the instructions of the Account Owner.
